Terms and Conditions

1. About these Terms
These Terms and Conditions (“Terms”) govern your purchase and use of RecruitAbility Pro.
RecruitAbility Pro is provided by RecruitAbility Ltd (“RecruitAbility”, “we”, “us” or “our”), a company registered in England and Wales.

By purchasing, accessing or using RecruitAbility Pro, you agree to these Terms. If you purchase membership on behalf of a business, you confirm that you have authority to bind that business.
2. Business membership
RecruitAbility Pro is designed for recruitment businesses and recruitment professionals using the membership wholly or mainly for business purposes.
By joining, you confirm that:

You are at least 18 years old.

You are acting in the course of a business, trade or profession.

The information supplied during registration is accurate.

You have authority to enter into the membership agreement.
If consumer law applies to you despite the business purpose of RecruitAbility Pro, nothing in these Terms removes any rights that cannot legally be excluded.
3. What membership includes
Membership may include access to:
-
Recruitment training and guidance.
-
Recruitment processes, playbooks and standard operating procedures.
-
Templates, documents, checklists and tools.
-
AI prompts and related guidance.
-
Business-development content.
-
Vacancy and candidate qualification resources.
-
Interview, feedback and offer-management guidance.
-
Community areas and member discussions.
-
New or updated resources added during membership.
-
Other support or content described on the sales or checkout page.
The precise content available may develop over time. We may add, update, replace or remove individual resources where reasonably necessary to improve or maintain the service.
4. Membership price and VAT
RecruitAbility Pro membership costs ÂŁ99 per month, including VAT, unless a different price is clearly displayed and agreed at checkout.
At the current UK VAT rate, the ÂŁ99 total comprises ÂŁ82.50 before VAT and ÂŁ16.50 VAT.
Any applicable price, promotional rate or complimentary access will be shown or agreed when membership begins.
If the VAT rate or tax treatment changes, we may adjust the applicable breakdown or total price as required by law. Any other increase to the recurring membership price will be communicated in advance.
5. Monthly subscription and automatic renewal
Membership is a monthly subscription.
Your selected payment method will be charged when you join and automatically charged again on or around the same date each month until the membership is cancelled.
By purchasing membership, you authorise us and our payment provider to take these recurring payments.
You are responsible for ensuring that your account, billing and payment information remains accurate and current.
6. Cancelling your membership
You may cancel your membership at any time.
Cancellation will normally take effect at the end of the billing period for which you have already paid. You will retain access until that date, after which your account and access to membership content will end.
You can cancel using any cancellation facility available within your account or by emailing [email protected].
Please send a cancellation email from the address associated with your membership and allow sufficient time for the request to be processed before the next payment date.
Cancelling membership does not automatically entitle you to a refund for the current billing period.
7. Refunds
Payments are generally non-refundable once a new monthly billing period has begun.
We do not normally provide:

Partial-month refunds.
-
Refunds for unused membership time.
-
Refunds because a member has not accessed the available content.
-
Refunds for a failure to cancel before a renewal payment.
This does not affect any refund or cancellation right that applies by law.
If you believe a payment has been taken incorrectly, contact [email protected] promptly so that we can investigate.
8. Immediate access and statutory rights
RecruitAbility Pro provides immediate access to digital content and membership services following purchase.
Where consumer cancellation rights apply, those statutory rights remain unaffected. If applicable law requires your express request or consent before digital content or services begin during a cancellation period, this may be obtained during checkout.
Nothing in these Terms excludes rights or remedies that cannot legally be excluded.
9. Accounts and login details
Membership is personal to the individual or business account for which it was purchased.
You must:

Keep login details secure and confidential.
-
Notify us promptly if you suspect unauthorised access.
-
Ensure information associated with your account remains accurate.
-
Take responsibility for activity carried out through your account.
Unless we have agreed a multi-user arrangement in writing, you must not share your login or allow another person to use your membership.
Each additional user may be required to hold a separate authorised account.
10. Licence to use membership content
All RecruitAbility Pro content remains owned by RecruitAbility Ltd or its relevant licensors.
While your membership is active, we grant you a limited, non-exclusive, non-transferable and revocable licence to access and use the content for your own recruitment business and professional development.
You may use and adapt templates and operational resources within your own recruitment activity, including appropriate use with your own clients and candidates.
You must not, without our prior written permission:

Sell, sublicense or commercially redistribute the content.
-
Share resources publicly or with unauthorised third parties.
-
Copy or reproduce substantial parts of the training library.
-
Record, download or reproduce videos except where a download is expressly provided.
-
Remove ownership notices or present our content as your own original product.
-
Use the content to create a competing training, membership or resource product.
-
Give another person access using your account.
-
Upload the content to file-sharing, AI-training or public-content services.
The RecruitAbility and RecruitAbility Pro names, branding and logos may not be used without permission.
11. Community participation
Members must communicate professionally and treat other members respectfully.
You must not post or share content that:
-
Is unlawful, defamatory, threatening, discriminatory or abusive.
-
Infringes intellectual-property, privacy or confidentiality rights.
-
Contains malware, spam or misleading information.
-
Discloses candidate, client or third-party information without appropriate authority.
-
Promotes an unrelated business excessively or disrupts the community.
-
Breaches professional, regulatory or data-protection obligations.
We may moderate, move or remove content and restrict community access where reasonably necessary.
12. Vacancies, referrals and collaboration between members
The community may allow members to discuss vacancies, referrals, leads and potential collaboration.
RecruitAbility Pro provides the environment for members to connect but is not a party to any arrangement made between members.
Members are solely responsible for:

Conducting appropriate checks and due diligence.
-
Agreeing responsibilities, ownership and commercial terms.
-
Recording fee splits or referral arrangements in writing.
-
Managing invoicing, payments and tax.
-
Protecting confidential and personal information.
-
Complying with recruitment, employment and data-protection law.
-
Resolving any disagreement arising from their arrangement.
RecruitAbility Ltd does not collect, distribute, guarantee or adjudicate fee splits between collaborating members unless it has expressly agreed otherwise in writing.
13. Member content
You retain ownership of content you submit to RecruitAbility Pro.
You grant us a limited licence to host, store, display and process that content as necessary to operate the platform and provide the service.
You confirm that you have the right to submit your content and that doing so does not breach another person’s rights or any legal, contractual or professional obligation.
Do not post confidential candidate or client information unless it is genuinely necessary, appropriately protected and you are lawfully authorised to share it.
14. Recruitment guidance and results
RecruitAbility Pro provides training, tools, practical guidance and professional-development resources.
It does not guarantee:
-
Vacancies, clients, candidates or placements.
-
Increased revenue or profit.
-
Any particular conversion rate or commercial result.
-
That every process or template will be appropriate for every situation.
-
Compliance with every legal, regulatory or contractual requirement.
Results depend on many factors outside our control, including the member’s decisions, actions, market, clients, candidates and business circumstances.
You remain responsible for your professional judgement, recruitment activity, business decisions and results.
15. No legal, tax or financial advice
RecruitAbility Pro does not provide legal, tax, accounting, financial or regulated professional advice.
Templates and guidance are starting points and may need to be adapted for your circumstances, jurisdiction, clients and working practices.
You should obtain advice from an appropriately qualified professional where necessary.
16. AI prompts and third-party AI tools
RecruitAbility Pro may provide AI prompts, examples and guidance. AI-generated results can be inaccurate, incomplete, outdated or inappropriate.
You are responsible for checking and adapting any AI output before relying on or using it.
Do not enter confidential information, personal data, candidate information, client information or special-category data into an AI service unless you are authorised to do so and have established that the use is lawful and appropriately secure.
Third-party AI services are governed by their own terms and privacy policies.
17. Third-party platforms and services
RecruitAbility Pro is delivered using third-party services, which may include Kajabi, payment providers, video platforms and other technology suppliers.
Your use of some features may also be subject to a third party’s terms or policies.
We are not responsible for an interruption, change or failure caused by a third-party service outside our reasonable control, although we will take reasonable steps to restore or provide access where practicable.
18. Availability and maintenance
We aim to keep RecruitAbility Pro reasonably available, but uninterrupted or error-free access is not guaranteed.
Access may occasionally be restricted because of:

Maintenance or updates.
-
Security concerns.
-
Technical faults.
-
Supplier outages.
-
Events outside our reasonable control.
We may change the technical delivery of the service provided that this does not materially undermine the overall nature of the membership.
19. Complimentary and promotional access
We may provide complimentary, trial, franchise, promotional or discounted access on terms communicated separately.
Unless otherwise agreed in writing:

Complimentary access has no cash value.
-
It may not be transferred.
-
It may be changed or withdrawn on reasonable notice.
-
It does not create a right to a particular future price or duration of access.
20. Suspension and termination by us
We may suspend or terminate access where we reasonably believe that a member:
-
Has materially or repeatedly breached these Terms.
-
Has shared an account or membership content without permission.
-
Has failed to pay an amount due.
-
Has misused the platform or community.
-
Has created a security, legal or reputational risk.
-
Has acted unlawfully or abusively toward another member or our team.
Where appropriate, we will provide notice and an opportunity to resolve the issue. Immediate action may be taken where reasonably necessary to protect members, confidential information, intellectual property, security or legal rights.
Termination for a serious breach may result in immediate loss of access without a refund, to the extent permitted by law.
21. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to that:

We are not liable for indirect or consequential loss.

We are not liable for loss of profit, revenue, business, contracts, opportunities, anticipated savings, goodwill or data.

We are not responsible for decisions made or action taken in reliance on membership content.

We are not liable for arrangements, disputes or losses arising between members, clients, candidates or other third parties.

Our total aggregate liability arising from the membership will not exceed the membership fees you paid to us during the 12 months immediately preceding the event giving rise to the claim.
These limitations apply to the fullest extent permitted by law.
22. Data protection
We process personal information as described in the RecruitAbility Pro Privacy Policy.
Members are independently responsible for complying with data-protection law in relation to candidate, client, colleague and other third-party information they handle or share.
23. Changes to these Terms
We may update these Terms to reflect changes in:

The membership or its features.
-
Technology or suppliers.
-
Pricing or payment arrangements.
-
Legal or regulatory requirements.
-
Our reasonable business practices.
We will give reasonable advance notice of any material change where practicable. Continued use after the effective date of revised Terms constitutes acceptance of those Terms.
If a change materially disadvantages you, you may cancel before it takes effect.
24. Transfer of rights
You may not transfer your membership or rights under these Terms without our written permission.
We may transfer our rights or obligations as part of a restructuring, sale or transfer of the RecruitAbility Pro business, provided that doing so does not reduce your legal rights.
25. Severability
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.
26. No waiver
If we do not immediately enforce a right under these Terms, that does not mean we have waived it.
27. Entire agreement
These Terms, the relevant checkout or offer details and our Privacy Policy form the agreement between you and RecruitAbility Ltd relating to RecruitAbility Pro.
28. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales.
The courts of England and Wales will have jurisdiction, subject to any mandatory rights that apply under applicable law.
